Privacy
India is still trying to establish a proper Privacy Law. Currently
the Privacy rights have been invoked under the Indian Constitution.
Some provisions of Information Technology Act extend the principles of
Privacy Rights and Privacy Protection in the Electronic space.
Presently a new Data Protection Act is being discussed and a draft
bill and an Expert Committee is working on its recommendations. This
will address what Supreme Court calls "Information Privacy". Once the
committee submits its report, we may expect a "Data Protection Act" to
be drafted. There is also work going on on a separate legislation
called "Health Data Privacy and Security Act". We need to await more
details about these two legislations to understand how the Indian
scenario shapes up. These columns will monitor the developments in this space.
