Data Protection Act

Though the primary aim of HIPAA India is to prepare SMEs in India for being HIPAA Ready, it is recognized that HIPAA readiness automatically provides a company with insights into Privacy and Data Protection.

This could enable the Company to strengthen it's preparedeness to the new Data Protection Regime of the European Union as well as the Section 43A (ITA 2008)  regime in India.

Where an organization in India is a hybrid entity handling HIPAA and non HIPAA activities simultaneously, it would be beneficial for the organization to simultaneously work for HIPAA compliance of its Health Care information division along with DPA compliance  or ITA 2008 compliance for its BPO decision which may be handling non HIPAA data.

Hence HIPAA For India encourages organizations to simultaneously go for enterprise level Privacy and Security upgradation that could meet not only HIPAA but also DPA and ITA 2008.

Presently a new Data Protection Act is being discussed and a draft bill is under preparation. This will address what Supreme Court calls "Information Privacy". There is also work going on on a separate legislation called "Health Data Privacy and Security Act".

We need to await more details about the legislation.
